Tình hình càng thêm bất ổn khi nguyên đơn khởi kiện một người không cư trú. Trong những trường hợp đó, tòa án không có quyền tài phán cá nhân trừ khi có thể chứng minh được rằng bị đơn không cư trú có liên hệ tối thiểu nhất định với quốc gia nơi vụ kiện được đưa ra.
